Poker star Phil Ivey to court: Let me keep my $10M in baccarat winning

A recent request by the Borgata casino to a federal judge for a refund of the $9.6 million won by legendary gambler Phil Ivey in 2012 has been formally contested by Ivey.

On Monday, Ivey's attorney disputed Borgata's claim that his profitable experiences - which came during his playing of baccarat on four visits to the Atlantic City casino - are "identical" to a 2015 case in which Golden Nugget gamblers had to give back $1.5 million in winnings in the same case.

In the Golden Nugget case, the playing cards were not - as required by state law - pre-shuffled due to an error by the playing card company. That led to a "recurring pattern" that several players noticed, allowing them to win 42 consecutive hands. A state court found that the error made the playing hands "unauthorized."

But Ivey points out that the ruling stemmed from that conclusion - not breach of contract, which is what the judge found in Ivey's case. Instead, the judge found that Ivey and his playing partner - who spotted tiny imperfections in the design of the playing card backs - "did not violate any rules or regulations."

The contention, then, is that the outcome of the Golden Nugget case doesn't necessarily mean Borgata gets its money back....
